Terms and conditions

These terms govern your use of this site and any order you place. Placing an order means you accept them. They do not affect your statutory rights under the Consumer Rights Act 2022 or the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

1. Who you are contracting with

2. How a contract is formed

Placing an order is an offer to buy. Our confirmation email acknowledges receipt; it does not by itself form a contract. The contract is formed when we dispatch the goods. If we cannot supply an item we will tell you and refund in full.

3. Prices

Prices are in euro and include VAT at the applicable rate. The price shown is the price you pay for the goods; delivery is calculated and shown at checkout before you commit. No charge is added after that point.

We correct pricing errors. If an item is listed at an obviously wrong price we will contact you before dispatch, and you may confirm at the correct price or cancel for a full refund.

4. Wholesale accounts

Approved wholesale customers see wholesale prices once signed in. There is no minimum order quantity and no minimum spend. Wholesale pricing is offered on the basis that you are buying in the course of a business, and we may ask for evidence including a VAT number. Where you buy as a business you are not a consumer, and the cancellation rights in these terms and in S.I. 484/2013 do not apply to you.

5. Stock and authenticity

All goods are sourced through authorised channels and supplied in original manufacturer packaging. Testers are described as testers. Batch codes and packaging vary between production runs; a difference in packaging is not in itself a defect.

6. Payment

Payment is taken at checkout through our payment provider. We do not store card details. Goods remain our property until paid for in full.

7. Delivery

Delivery terms and timescales are on our Delivery Information page and form part of these terms. We deliver within 30 days unless agreed otherwise. Risk passes to you on delivery.

8. Cancellation and returns

Your 14-day cancellation right, the sealed-goods exception that applies to fragrance, and your rights over faulty goods are on our Returns and Cancellations page and form part of these terms.

9. Your account

Keep your password to yourself and tell us at once if you think someone else has used your account.

10. Our liability

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, nor for business losses where you buy in the course of a business. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded, including under the Consumer Rights Act 2022.

11. Use of this site

You may browse and buy. You may not scrape the site, copy the catalogue, or use it to build a competing listing. Product images and descriptions are used under licence or are our own; brand names and marks belong to their owners.

12. Changes to these terms

We may change these terms. The version that applies to your order is the one published when you placed it.

13. Complaints and dispute resolution

Write to info@thescents.co.za; we aim to acknowledge within two working days. If we cannot resolve it, you may seek advice from the Competition and Consumer Protection Commission (ccpc.ie), or from the European Consumer Centre Ireland (eccireland.ie) for a cross-border purchase.

14. Governing law

These terms are governed by Irish law. As a consumer you may bring proceedings in the courts of the country where you live, and you keep the protection of the mandatory consumer law of that country.
